-  The Judiciary is NOT Supreme!  Stephen Miller argued that a judge cannot singlehandedly strike down the President’s executive order on immigration because we have equal branches of government in this country.  CORRECT.

After 9th Circuit unanimously ruled to reject the Justice Department request to lift a Seattle judge’s restraining order on President Trump’s immigration order this week, Miller CORECTLY said that the judicial branch is not supreme.

We have equal branches of government in this country.  The judiciary is not supreme. A district judge in Seattle cannot force the President of the United States to change their laws and our Constitution because of their own personal views.  The president has the power under the INA, Section 212 F8 USC 82 F (ph) to suspend the entry of aliens when its in the national interest.

Stephen Miller reacted to the 9th Circuit Court ruling upholding the blocking of President Trump‘s executive order halting immigrants from 7 Muslim-majority countries from entering the United States.  Miller said CORRECTLY there was no such thing as judicial supremacy.

We are considering all of our options. That includes continue the appeal on the 9th and seek an emergency stay in the Supreme Court, and you can have a trial hearing on the merits at the district level or a hearing also at the 9th circuit and pursue additional executive actions. The bottom line is we are pursuing every single possible action to keep our country safe from terrorism. What the judges did is take power away that belongs squarely in the hands of the president of the United States.

-  President Trump Has a Law That Will Allow Him to Bypass the 9th Circuit.
Section 243(d) of the Immigration and Nationality Act allows President Trump to refuse visas to any country he deems uncooperative.  Even if President Trump cant convince the courts to approve his extreme vetting executive order, he may have another tool at his disposal that would allow him to strip visas from some of the 7 countries.

A federal law says the government can stop issuing visas to countries that are deemed uncooperative because they refuse to take back their citizens when the U.S. tries to deport them.  Thats Iran, Iraq, Libya, Somalia and Sudan.  All Mr. Trump would have to do is have his Homeland Security Department secretary issue an official notification about those countries, and the State Department would immediately halt visas.

From Lifezette: The Supreme Court on Tuesday is taking up a case that presents a critical question of law: Can a U.S. law enforcement officer be sued in American courts for the death of a foreigner outside the United States? For most of American history, the answer to that question has been a clear and emphatic “no.”

Courts for two centuries have held that constitutional rights do not apply to foreigners with no voluntary connection to the United States. That the high court even agreed to take Hernández v. Mesa casts doubt on that long-held understanding of the law, however. “That has been under a lot of pressure and challenge recently,” Fordham University School of Law professor Andrew Kent told reporters on a conference call last week.

Trump, No. 17-35105 (Motions Panel–February 9, 2017) U.S. COURT OF APPEALS BYBEE, Circuit Judge, with whom KOZINSKI, CALLAHAN, BEA, and IKUTA, Circuit Judges, join, dissenting from the denial of reconsideration en banc. I regret that we did not decide to reconsider this case en banc for the purpose of vacating the panel’s opinion. We have an obligation to correct our own errors, particularly when those errors so confound Supreme Court and Ninth Circuit precedent that neither we nor our district courts will know what law to apply in the future.

Gorsuch confirmation April 7

-  Repubs will probably use the nuclear option.  If Demonrats dont like it, they can vote for Gorsuch and not hang onto past LIE.  2 Democrats will support Gorsuch’s confirmation, WV Sen. Joe Manchin and ND Sen. Heidi Heitkamp.  Hints Trump will put another justice on USSC this year.  2 may retire and hopefully Ginzburg will die or leave.
